Terms and Conditions

Intro

As the world’s largest music database, we provide music professionals with our Annual Music Report (“Report”), consisting of interesting and useful insights into the music industry and its trends. These Terms and Conditions (“TaC”) set out how Viberate will provide the Reports to its users. TaC may be changed, revised or amended by Viberate by posting the changes under this section. You are advised to periodically visit the TaC page to review the current TaC.

Eligibility

The Reports are free of charge for all eligible users. To be eligible to receive the Report, you must complete the registration process by providing the information requested on the registration form. You are responsible for ensuring that any information provided is current and accurate. Viberate is not responsible for any loss of communication resulting from the omission of providing accurate contact information. Should Viberate suspect that any information you provide is not current or accurate, Viberate has the right to suspend or terminate your right to receive the Report.

Privacy Policy

Viberate may collect the following information:

  • Basic information: your first and last name, the company you work for
  • Contact information: your email address.

However, you are the one in control of our possibility to collect and retain your personal information. You may contact us to delete any/all of your personal information at any time, by contacting info@viberate.com. You can also receive the list of your personal information that we currently keep by contacting info@viberate.com. Please note, that by requesting deletion of your information, you might become ineligible to receive current or future Reports.

We use collected information with the main purpose of sending you the Reports. We also use collected information for direct contact, internal record keeping and research. All collected information helps us to maintain the quality of our services and to protect you from any unauthorized action. The information we collect is not distributed, sold or leased to third parties for commercial purposes, except to provide services you’ve requested or for other purposes when we have your permission or when we are obliged to do so. The Report may contain links to other sites on the Internet which are owned and operated by third parties. You acknowledge that Viberate shall not be held responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by these TaC.

We store collected information until it is no longer necessary to provide the Reports, or until you revoke consent, whichever comes first. This is a case-by-case determination that depends on things like the nature of the information, why it is collected and processed, and relevant operational or legal retention needs.

Warranty Disclaimer

The Reports are provided “as-is” and “as available” and Viberate expressly disclaims all warranties and conditions of any kind, whether express or implied. You understand and acknowledge that the Reports may not be exhaustive, and the analysis of the content is based on what users and third-party data sources provide to Viberate. Viberate does not guarantee and does not promise any specific results from the use of the data, contained in the Report (“Data”). Viberate makes no warranty regarding the outcomes obtained or derived through the use of Data. The Reports are planned to be published in the first half of the calendar year for the previous year, however, Viberate makes no warranty regarding the timeliness of the publication.

Limitation of Liability

Under no circumstances shall Viberate or its third party licensors be liable for any direct, indirect, consequential, exemplary, incidental, special or punitive damages, including but not limited to loss of data or profit, arising from or relating to your use of Data, even if Viberate has been advised of the possibility of such damages and notwithstanding the failure of essential purpose of any remedy.

Indemnity

You agree to indemnify and hold Viberate, its subsidiaries, affiliates, officers, agents, and other partners and their employees, harmless from any loss, liability, claim, demand, costs, or expenses, including reasonable attorney’s fees, brought by any third party arising out of or relating to: (a) your use of Data (b) our use of Data in accordance with the terms hereof, or (c) your breach of these TaC.

These TaC govern your access to the Report. You may not, by operation of law or otherwise, delegate or otherwise transfer your rights or obligations under these TaC to any third party without Viberate’s prior consent, and any attempt to do so will be void. If any provision of these TaC is held invalid, the remainder of these TaC shall continue in full force and effect. If any provision of these TaC is found to be invalid or unenforceable, such provision will be changed and interpreted to accomplish the objectives to the greatest extent possible under any applicable law and the remaining provisions will continue in full force and effect. No failure or delay in enforcing any right or exercising any provision will be deemed a waiver of any right or provision.
